Triebel-IP was established by Jens Triebel in July 2015. After having spent 6 years in South Africa’s largest intellectual property firm, Adams & Adams, and 8 years as a director of Spamer Triebel Inc., Jens preferred the freedom and independence of a sole practice, where he, assisted by an able team, sets optimal, tailor-made intellectual property strategies for clients.

We focus on fostering a partnership relationship with our clients, advising them on the selection, availability, use, protection, licensing, transfer and enforcement (including anti-counterfeiting) of intellectual property rights (trade marks, patents, designs and copyright), nationally and internationally.

We are able to draft a wide variety of intellectual property related instruments, including licensing, franchising, merchandising and distribution agreements.

JENS TRIEBEL

Jens Triebel has degrees in Commerce and Law and more than 30 years’ experience in intellectual property and international trade law. He was a trade diplomat in Geneva from 1989 to 1996 where he represented South Africa at the GATT, the World Trade Organisation and the World Intellectual Property Organisation and was involved in the negotiation of multilateral trade and intellectual property agreements. He was Deputy Registrar of Patents, Trade Marks and Copyright for a brief period (1996 – 1997) before qualifying as an attorney in 1999 and a trade mark practitioner in 2000. In 1999 he joined South Africa’s largest intellectual property firm, Adams & Adams, where he became a partner in its Johannesburg office in 2002. In 2006 Jens co-founded Spamer Triebel Inc. in Cape Town. He left the firm during the latter half on 2013 and practiced briefly with the Cape Town IP firm Brian Bacon Inc. until mid-2015 when he relocated to Pretoria to establish Triebel IP.

Thulani holds an LLB degree from the University of South Africa and entered the legal profession in 2003.    He has a wealth of experience in trade mark management and is a specialist in anti-counterfeiting, customs registrations and recordals, market actions, criminal and civil proceedings in anti-counterfeiting matters and anti-counterfeiting administration. Thulani is also the Trade Marks Manager at TRIEBEL IP.

PRACTICE AREAS

  • TRADE MARKS

    Trade marks serve to distinguish the brand owner's goods or services from the goods or services of others. A trade mark is, generally speaking, any sign or indication which can be represented graphically, is used or proposed to be used and may include a word or words, a device, a combination of letters and/or numbers, a logo or a container for goods.

    Our trade mark practice advises on the selection, availability, use, protection, licensing, transfer and enforcement of trade mark rights, nationally and internationally.

    Where trade mark disputes arise we aim to negotiate co-existence and settlement agreements and where this is not possible, we enforce and defend our clients’ rights through litigation, opposition and cancellation procedures.

    The maintenance and management of trade mark portfolios is a central area of activity, which we conduct with diligence for a number of high profile trade mark proprietors, in particular in the food and beverage industries.

  • COPYRIGHT

    Copyright may vest in works originated by authors and creators of literary, musical, artistic and other works recognized by the Copyright Act, including computer programs.

    Unlike trade marks, patent or design copyright (with the exception of copyright in cinematograph films) is a non-registrable right which automatically comes into existence when a work is reduced to material form. It has a limited lifespan, generally twenty years after the death of the author.

    By owning the copyright in a work, the owner has the right to the exclusive use of the work and can control the commercial exploitation thereof, either personally or by licensing others to do so. We provide advice to prevent and protect copyright infringement, enforce such rights and draft license agreements, as may be appropriate.

  • PATENTS

    Patents relate to inventions and innovations and afford the patentee the exclusive right to manufacture, import, use, distribute or sell the patented invention or patented technology in the country where it is patented. We assist our clients in identifying, prosecuting and registering patent rights and cooperate with leading patent attorneys in South Africa and abroad in all disciplines of patent law and on a wide range of technologies, nationally and internationally.

  • DESIGNS

    Designs may be obtained by registration to protect the particular appearance and shape of industrial articles. Where patents relate to inventions and innovations registered designs specifically protect the shape and configuration of articles to which a design is applied.

  • ANTI-COUNTERFEITING

    As brands become successful and valuable business assets, counterfeiting and piracy become a growing challenge to trade mark proprietors.

    We work with leading investigators and/or government institutions and assist clients in identifying counterfeiting activities and perpetrators and offer anti-counterfeiting monitoring and enforcement through criminal and or civil prosecution.
